Compliance Reminder: Consolidated Appropriations Act Gag Clause Prohibition Compliance Attestation Due December 31, 2023

We are writing to provide you with an update on MedCost’s support for the upcoming gag clause prohibition attestation requirement. As you may know, the Consolidated Appropriations Act of 2021 (CAA) includes a provision that prohibits group health plans and health insurance issuers from entering into or enforcing contracts with providers that would directly or indirectly restrict a plan or issuer from accessing or sharing certain data or information. 
 
The Gag Clause Prohibition Compliance Attestation (GCPCA) requires group health plans and health insurance issuers to attest to their compliance with gag clause prohibition by December 31, 2023, and subsequent attestations are due each year by December 31. MedCost is committed to helping our clients comply with this new requirement. We have reviewed our network and provider contracts and confirmed that they do not contain any prohibited gag clauses. We have also obtained similar assurances from third-party networks that we contract with. MedCost is prepared to complete the attestation for active clients for products accessed through MedCost, including medical and pharmacy, if applicable.
